Interesting, and supportable if it would then make the the process for direct amendment of the Constitution by the States easier. However, by the wording of Article 5, Congress is really not an impediment. I do support removing the Congressional choice of mode of ratification for States amendment actions from Article 5. I say let the States convention set the mode of ratification at the time the proposal for an amendment is made. In this way the States and Congress are on equal parity in the matter. If Congress proposes an amendment, let it pick the ratification mode. If the States propose and amendment, let the them pick the ratification mode. In either case, it should still be a choice of 3/4 of the State Legislatures or 3/4 of the State Ratification Conventions. However, it should be set as one mode or the another, else the several States themselves will become bogged down with both Legislatures and Conventions in individual States vying for primacy, rendering either no result of endless litigation.
