Interesting day yesterday. Pulled over (SDRO suspended licenced due to non payment of penalty) for a RBT (midday on a Thursday?). This saga has been going on since April. I did not refuse RBT, however I would not give over my name and I did not produce licence. I now have a court appearance date set in January. They made an assumption based in the licence plate number (and would you know it the cop was someone I knew years ago). Turns out he remembered my name, but not surname. Nevertheless, I was ordered not to drive my car (and they did re-state this is MY car). Told me the conversation was recorded. I told him.. I absolutely will not pay the extortion fee of $712 for being unregistered (2 days)! My tact is to write to the Local Court first to have the matter discharged along with my affidavit and requesting proof of claim. If I go to court I plan on laying out what I will reveal in court along with a swag of witnesses to come with me. As I live 42ks from home (no public transport), I told the cops (by now another sargent had stepped in also), that I would be drving my vehicle home. Their answer? Then dont let us catch you as you will be arrested. I restated many times I would be driving my vehicle home. I reiterated multiple times I do not consent. I do not consent to their jurisdiction I asked if I was free to go or being arrested. They said I was NOT free to go. They issued court notice for driving with expired licence. Can you believe this? SDRO suspended my licence and now they are getting me for not having a current licence? WTF!!! Initially I was unsure about what he was saying, but apprently on licence check my licence had expired. I said I had no idea, They say You should know when your licence expires. I say How many people do you reckon know when their licence expires. He says Well it is on your licence. I say well why would I bother looking.. its not like it is something we all look at on a daily basis? FFS!! I walk 1k to the court house and speak with the desk clerk. As the matter is not being heard until January this effectively leaves me without transport until this matter is heard. (No means of escape (in bush fire), no means to get food. County people are severely disadvantaged!!!) I said I wish to speak to Magistrate (none here today). I advised I wished to bring into action a Writ of Habeus Corpus. (She has no idea what it was) [groan]. I say Google it. So.. in summary.... 1. April penalty issues for $605 for driving unregistered. 2. Letter to SDRO stating no joinder with SRDO (Reg mail) 3. Penalty reminder sent. 4. Follow up letter to SDRO to Mick M :-) 5. Letter from Mick M (standard letter), offering payment options or court election for another $50. 6. Meanwhile.. letters of Non Consent sent to GG, PM, Local Members, Local Court House, Scippione (Police Commisisoner). Attorney General, Federal Member, Notary Public, etc etc etc (17 pages, witnessed and sent registed post). 7. researched and found out that SDRO cannot quash penalty notice. Just received letter from GG in response to my NOTICE OF NON CONSENT and declaration of Sovreignty. Wil post it later. All others no response. The whole time I was speaking I was advising the officers of known truths. They were all laughed at. Mocked. One said... you a Soveriegn are you?. I say arent you? (no response). I say.. Guys.. you really are so uneducated, and we ALL need you to GET educated about what is going on. (wry smile and mock laugh from them both). The bottom line is I want to stay out of THEIR court. My intention is to have this unlawful matter quashed. Any info gratefully accepted in preparation of my letter and affidavit. Cheers.
