Is istihlāl a condition for Takfir on the one who rules by other than the law of Allah? al-Allāmah Muhammad Ibn Ibrahīm Āl As-Shaykh (رحمه الله) responded to those who stipulate that a ruler has to make Istihlāl before it is allowed to make Takfīr on the (same) ruler who does not rule by what Allah has revealed: ولو قال من حَكَّمَ القانون: أنا اعتقد أنه باطل، فهذا لا أثر له، بل هو عزل للشرع، كما لو قال أحدٌ: أنا أعبد الأوثان واعتقد أنها باطل And if the one who rules with the Qānūn (man-made laws) says: I believe that it (Qānūn) is falsehood, there is no evidence (to prevent Takfīr) based on this, rather he has replaced/removed the law (of Sharīah). It is like a person saying: I worship the idols and (yet at the same time) I believe they are false. [Fatāwā wa Maqālāt al-Allāmah Muhammad Ibn Ibrāhīm 6/189]
