Is this the response everyone else is getting to the request for public records? Or am I the only one? Not to mention they misspelled my name,, they changed one of my Cs to a Ds...... grave error.. The Public Records Act provides that the authority to formally mediate and rule on Public Records disputes lies with the Courts. (see N.C.G.S. §132-9). Our Sheriff had presented publicly to the Burlington City Council last month and again to our county commissioners this past Feb 17, that “private people” were involved in investing in the planned training facility the County Manger’s office had been working to shove into our community against our community’s best interest or wishes. We have been waiting since Feb. 5 for the requested names of these ‘private people’, but have been unable to get information from the County Attorney, though his office did release 39 emails going back to Dec. 30. I am writing to you to ask your help to be our “liaison between public officials and the public” in this public records request. Your website says: “The policy of the state of North Carolina is to allow the public access to the business of government. We (North Carolina Department of Justice) help by acting as a liaison between public officials and the public.” Public Records laws specify: • What kinds of records the public may access • Which government agencies must disclose records • How public records laws may be enforced if agencies do not allow their records to be examined Your website further says: Call or email the Attorney General’s Victim & Citizen Services section at (919) 716-6780 to get help on open government issues. So, we are emailing you, as individual citizen’s from Alamance County, asking for assistance in this open government issue. Please have a representative from your office contact me or attend our communitys next public forum meeting, scheduled for March 15, in Saxapahaw and tell us how we can acquire this requested information. During your excellent presentation to the Mayors council you mentioned We do have some private people that has expressed interest to assist us in this endeavor towards keeping the costs down and with the private involvement in the finances, we feel we may be able to bring this training center about here in Alamance county. There are two sites being looked at; one is right outside of Swepsonville and one is off the Austin Quarter road, near the [current] landfill. That particular site, at this time, looks the best as far as the cost, and as far as the safety of anybody surrounding that particular training center. Based on these statements regarding the safety assurances to our community, the costs expected and the mention of private investors, CERES would like to know more about where this private funding originates. Therefore, based on the Public Records law, § 132-1, please accept this as my formal request to EXAMINE any and all documents, memos, maps, video or audio recordings, budgets, emails and any correspondence between you or your staff and/or any outside agency or private individual(s) regarding private or public funding for this facility, near Saxapahaw, In relation to any mention of development of this property for a training facility of any kind, since 1993. Please include in this request to EXAMINE this material, any additional material with any mention of the 1100 acre parcel adjacent to the current 400 acre landfill, adjacent to this property in question, currently owned by the estate of Bruce Cameron of Wilmington, NC. Please understand that we do not want copies of this material, but instead, under the Public Records sub-statute, § 132-9; Access to records, we are asking to come to your record keepers office and EXAMINE these records in person. Thank you for your staffs help in collecting these documents and taking their valuable time to show them to us. Given the quick response from County Attorney Albright (on the order of a few days) to our request to his record keeper, Im sure it will not take your record keeper much time to pull together your records, as well.
