It is Common Knowledge that the three Pillars of Democracy are Judiciary , Legislature (political system) and the Executive ( burecraucy ). The design of such a system works only if all the three pillars function independently without interference from the other Pillars. But in actual practice this system has not only failed miserably but also has come to a certain stage where it becomes absolutely absurd to carry on with such a system and in reality is bringing the country down day by day. We will start with the Executive Pillar. This branch actually includes Bureaucrats who actually are part of the administration process including IAs, IPS,etc upto any goverment employee. The actual average salary paid to a top official such as a collector or superintendent of police is approximtely 80 thousand a month with perks extra. Now such an officer can averagely earn more than 5 crores a month by not even going out of the way. He does not have to even do illegal things. All he has to do is sign some government orders favoring some individuals or possibly omit some orders which indirectly favors some individuals. At the end of his day such an officer will be so powerful that any legal person can conclude that it is within his discretion to do or omit such an act. Now there are some straight forward officers also, but in such a corrupt system they are actually a bane and not a boon. They will be standing alone preaching something while the entire system is corrupt. For example if somebody wants to get any government order they have to give a bribe to the concerned minister now the concerned minister after getting the money will sign the order but there will be some straight forward officers who will oppose this and at the end of the day the affected party will be the public. This is the main reason straight forward officers will never last in key posts because the politicians cannot misuse them and are usually transferred to some low key posts. So we can conclude in this system it is better to be corrupt and harmless rather than being straight forward and harmful. But why would anyone want to be straight forward in such a system. There is no proper independent checking device against corruption. All existing devices are just a laugh and they function under some other pillar and is not independent. We can all agree that most government authorities are corrupted to various extents and no action is taken on these very corrupt people. People getting caught are actually the fools who have possibly taken a bribe of 1000 to 10 thousand whereas actual officials taking crores escape. I had earlier written about a false police case for running kangaroo courts which is clear example of the misuse of the discretion given to such authorities (blatant misuse of power). We can also confidently say that only the corrupt will survive in any scenario. The political system and judiciary system is also equally funny. Most judges agree that in India the law is so ineffective that there is an unwarranted delay in getting justice. For eg I handled a case where a certain landlord had been away from his property for quite some time. And one day after 6 years when he visited the property the property has been usurped by some Fraudulent elements by forged documents and the property has been sold for more than 6 times and finally in the possession of an innocent buyer who has built a big house. Now the concerned authorities were trying to convince my client to calmly accept a small settlement and go away rather than vacating and arresting the wrong doers citing the reason that it is a civil dispute and will take more than 10 to 15 years to get a judgment in the court. The problems faced by the executive is also faced by the judiciary. A Prosecutor will be paid rs 500 for fighting one case whereas he can earn more than rs 10 lak for just allowing one or Adjournments. I don’t even have to start with the political system. In tamil they say “ Mudal konal Muttrum Konal” (The first is twisted everything else is twisted). The political system in India is developed in such a way that normal educated people cannot get into it. You have to be ruthless, respectless, ready for everything, corrupted, etc to actually get into politics. The other politicians will go after your respect, your wealth, your family, everything possible to malign your name. And very rarely genuine educated people survive such dreadful nightmares. Again we reiterate the fact that the basic requirement is to be corrupted . Well the system functions in a way that only by corruption you will survive. And everybody is happy if you are corrupted. If you are a executive or a part of the judiciary who is corrupted you can be easily manipulated and you will be forever under the control of a politician and this works vice versa in all possible ways. The appointment of judges and executive in key posts is done by by politicans then where is the quesntion of answerability. It is sad to note that our country has no future unless this system is changed. Whether it is possible is a big ask. A strong leader can do all the difference. So its time educated people get into politics without thinking of themselves. Voting is a duty of all for bringing a strong and clear leader and government. Corruption should be discussed in forums like these and we should stand united to bring down such corrupted officials. I love my country too much to keep quiet and watch.
