It is LEGAL to OPT out of these Tests! Just as it was legal, by the word of the NY State Commissioner of Education, to opt out of the actual testing! I complained to the Supervisor of District 26 that some Principals were telling parents that these Field tests are mandatory and one of the Parents got a call from her advising her that parents DO have the right to opt out. I also have been advised that several parent advocacy organizations are questioning the legal aspects of this.
