It is held by supreme court that value of Diyat is to be considered accordingly at the time of compromise/judgement/decision. The punishment of Arsh & daman is awarded with respect to percentage of the value of Diyat. Question is; whether at the time of awarding punishment of Arsh & Daman, value of Diyat is to be considered that accordingly at the time of occurrence or that of the time of compromise/judgement/decision??? I need valuable comments of my learned brothers especially Keeping in view the preposition; as, while awarding punishment of any kind, quantum of the same is considered whether at the time of compromise/judgement/decision or occurrence???? Dear learned i need your valuable comments!!!!!!
