Its illegal to lock-up anyone in the U.S. for simply being poor. Specifically, its unconstitutional to jail a probationer for failure to pay a fine without first inquiring into their ability to pay. But private probation companies have found a horrible way around this law. Instead of fines, the courts issue probation and assign probationers to a private probation company. Of course, the probationer must pay the monthly fee to the private probation company. Miss a payment? Go to jail. Now, a bill headed to Gov. Nathan Deal’s desk would give unprecedented new power to the private probation industry.
