EXCERPT: The state attorney general today released an opinion concluding that Blaine Youngs recent appointment to the Frederick County planning commission was invalid. The conclusion is grounded in laws that prohibit a governing body from appointing one of its members to another body, according to the opinion. In this case, Young was appointed in late November to a five-year term on the planning commission by fellow members of the board of county commissioners. [T]he statute does not give the BOCC the power to appoint Mr. Young as a citizen member of the planning commission. Mr. Young was thus ineligible for the position, and his appointment was ineffective from the outset, stated the opinion signed by Maryland Attorney General Douglas F. Gansler. Frederick County Executive Jan Gardner had asked Gansler to weigh in on Youngs appointment and said the attorney generals opinion would guide her actions.
