Ive just got off the phone with PayPal (0333 044 8905) and theyve escalated my case to a team thats dealing with similar concert/festival cancellations post the 45 day dispute resolution process. They are aware of the Jabberwocky / Dash Tickets debacle already and have had quite a few calls. But first, I opened a dispute on PayPal against Dash Tickets anyway (which of course was automatically closed as it was after the 45 days) – the woman at PayPal said that this made their job easier, as they don’t need to take all the details over the phone and can just reopen that closed case. If you do this, then hit the ‘Contact us’ button on PayPal, it’ll give you a code that you enter on the phone, so that they know your account details when you phone them. Anyway, PayPal weren’t particularly helpful (although very nice!) – they aren’t currently prepared to issue refunds until an investigation has been conducted and did advise that a credit card chargeback would probably be quicker and easier. For anyone who isn’t covered by chargeback, this PayPal investigation sounds like it might be your ticket to a refund (see what I did there?!). Just to confirm as well – despite what Dash Tickets may state, they are liable for the costs of refunds to customers under UK consumer protection. Our payments were to Dash, our receipts were with Dash. If Dash have handed over that money to ATP already, that’s their problem, not ours. Any credit card chargebacks will be made against PayPal, who will be recharging Dash Tickets. I’m holding off for a day on making a chargeback application, in the vague hope that Dash and ATP can sort this out amongst themselves. I’ve sent them both this email: Nick at Dash Tickets and the ATP team, As I am sure you are both aware, currently you are both passing Jabberwocky festival go-ers from one organisation to the other and both denying responsibility for refunding paying customers. All Tomorrows Parties (Willwal LTD) initially advised in an email of Tuesday 12 August 2014 (attached) that customers should contact the point of purchase for refunds, while that point of purchase (Dash Tickets) are denying refunds based on the below email and the facebook statement also attached. Can you please come to an agreement between yourselves what is the appropriate route for your customers to receive their money back within the next 24 hours. The next step on from this email will be a credit card chargeback or small claims court action against Dash Tickets - my receipt for the tickets is from Dash Tickets and it was Dash Tickets that I conducted business with. How you pursue All Tomorrows Parties for funds from that point onwards is not my concern as your customer. To that end, please provide a valid physical business address for any future correspondence to be sent to - neither your dashtickets.co.uk/ website or facebook page appear to display one. I expect a response by email - or appropriate statement publically issued by both Dash Tickets and All Tomorrows Parties (Willwall LTD) by 0900 on Thursday 14 August 2014.
