JAKE STRICKLAND -- CALL FOR SUPPORT AND NOTICE OF HEARING. Ive attended many Utah Supreme Court hearings over the years, and read 100s of appellate decisions. Chris Carlton, Jacob Brooks, Rob Manzanares, Bobby Nevares, Nik Thurnwald, Cody ODea, John Wyatt, and Will Bolden have all had their cases heard by Utahs highest court. Now it is Jake Stricklands turn. COME PACK THE COURTROOM WITH US ON WEDNESDAY, OCTOBER 8, 2014, AT 9:00 A.M., AT THE MATHESON COURTHOUSE, 5TH FLOOR, 450 SOUTH STATE STREET IN SALT LAKE CITY. If you cant come in person, then live stream it through the courts website. If you cant live stream it, then send Jake and Baby Jack some love. Heck, send them some love anyway. This is a critical case in Utah, as it deals with several issues of first impression (meaning the Utah Supreme Court has never considered such issues before), including various aspects of the constitutionality of Utahs Adoption Act, including the fraud immunity provision which statutorily permits a birth mother (and those working with her) to lie, deceive, misrepresent, and commit fraud in conjunction with the placement of a child for adoption -- without the birth fathers knowledge or consent. See Utah Code Ann. Section 78B-6-106. Other cases, like Chris Carltons raised those issue at the trial court level, but the court ruled against Chris before even reaching the constitutionality issues. Chris win in the Utah Supreme Court now requires the trial court in his case to consider and rule upon those constitutionality issues, including fraud immunity -- stripping a birth father of his due process rights to fair notice and an opportunity to be heard. See the U.S. Supreme Court case of Matthews v. Eldredge. Hopefully the shifting tide in favor of birth fathers will continue as Chris case moves forward, and certainly as Jake Strickland appears before the Utah Supreme Court on Wednesday. We expect the next time to be in court for Jake, after this Wednesday, will be to coordinate the reunification of Baby Jack with his father. The only other court we will be in, if not dealing with transition issues, will be the United States Supreme Court in Washington D.C. I suppose when Jake wins in the Utah Supreme Court, those opposing him could take the case to our Nations Capital. Were ready. We will never give up. To those who oppose the elimination of fraud immunity and unethical conduct from Utahs adoption practices, who think its okay to encourage fraud in adoptions, and engage in other unethical practices -- your days are numbered. If those who oppose us are looking in on our goings on at BFU and reading these words, I speak directly to you. It is time for you to find a better way to conduct adoptions, and even better yet, perhaps it is time for you to look for something better to do with your lives.
