Jason Davis, in todays NJ: A Volusia County Charter Amendment cannot violate Florida law. But it wont. Davis states that Fla. Statute 161.58 gives the County Council its right to the say on beach traffic. That statute is in Pic #1 below. See the excerpt from part 2-b of the statute in Pic #2. The state rules are NOT applicable in any county which adopted beach regulations in a home rule charter before Jan., 1988. We were actually the 1st county in Florida with a home rule charter: June 30, 1970. Mr. Davis premise is incorrect. Our proposed amendment would not violate the state law.
