Javier files Motion for Reconsideration Ely Suyom SAN JOSE, Antique - Gov. Exequiel B. Javier said that he will file a Motion for Reconsideration on the recent resolution released by the Commission on Elections (COMELEC-Manila) regarding the election case filed by Valderrama Mayor Mary Joyce Roquero. “I am ready to bring the case to the Supreme Court,” said Javier. It can be recalled that the COMELEC issued a five-page resolution finding a probable cause to try Javier for an election offense for ordering the suspension of Mayor Roquero during the election period this year. It was learned that the COMELEC Law Department has not yet filed an information at the municipal trial court here in Antique. Javier added that the Comelec has not resolved the legal questions related to the case. Javier said that he followed the provisions in the Local Government Code (LGC) and not the Ominubus Election Code regarding the number of days in suspending a municipal mayor. It can be recalled that on January 23, Javier suspended Roquero for 30 days in relation to the administrative case filed by Valderrama Vice-Mayor Christopher Maguad at the Sangguniang Panlalawigan. Roquero defied the suspension order and questioned its legality. She did not step down to her office until her re-election on May 13, 2013. The Omnibus Election Code prohibits the suspension of any elective public official during the election period without the approval of the Comelec or unless the suspension is related to graft and corruption. Meanwhile, Javier said that there is no truth to the rumor that he will be disqualified from holding office as what his detractors informed the public here in Antique. The COMELEC has no judicial power the very reason why they will file the election case in court. “If I am convicted in the lower court, I will bring the matter to the higher court,” Javier told this writer. As of press time, Javier filed his motion for reconsideration on the resolution of COMELEC in a case filed by Roquero.
