Jubilee Backtracks On Ngilu BY DAVID MWERE Tuesday, November 12, 2013 Jubilee coalition MPs yesterday did a U-turn and resolved to back Lands Secretary Charity Ngilu. The MPs said their interest was to get Ngilu to obey the law but not to be removed from office. Leader of Majority Adan Duale, who Ngilu allies claimed was behind the plot to remove her, announced that Jubilee will not support the new parliamentary motion by Eldas MP Adan Keynan. Keynan has filed a motion with the Clerk of the National Assembly asking President Uhuru Kenyatta to fire Ngilu for gross misconduct after MPs adopted a report that found she had irregularly appointed Peter Kahuho as Director General of Lands in October. Duale said the House will not censure Ngilu but will compel her to ensure the committee recommendations are implemented. “It was a committee report and not a censure motion. She can’t be removed from office through a committee report. Jubilee coalition is not supporting the motion and we will oppose it once it is brought to the House for debate,” said Duale. Yesterday, Keynan said that he was still determined to raise the 87 signatures required to censure Ngilu. “I have made good progress in collecting the signatures and be assured that the matter will be debated in the House this week,” Keynan said. “Any member who believes in constitutionalism and the rule of law must support this motion. I personally will vigorously lobby like-minded members to have it passed. We must decisively deal with impunity,” said Ugunja MP James Wandayi of ODM. The law requires that the mover of the censure motion must deposit a copy with the Clerk of the National Assembly including the grounds for removal plus the signatures of a quarter of the 349 MPs. In October Ngilu created the position of Director General of Lands, appointed Peter Kahuho, and fired commissioner of Lands Zablon Mabea on health grounds. She rescinded her decision a few days later amid a storm of controversy. Noting that the National Assembly adopted a report on the departmental committee on lands, cognizant that the report found that Ngilu grossly violated Article 234 of the constitution, pursuant to the provisions of Article 152 (6,7,8,9 and 10) of the constitution and standing orders 61,62,63,66, 67 and 68, this House requires the President to dismiss the Cabinet Secretary, Keynans motion reads.
