Judicial power in Islam (high court and government security) While discussing Islam and democracy, the activities of judicial and government security organs cannot be ignored. In Islamic societies, there are severe shortcomings in the organs of judicial investigative, interrogation, and justice procedures. In fact, it could be said that the justice system within Islamic countries is extremely inhumane and anti-democratic. All the misuses seen in parliamentary elections are evident within the election of the justice system. As in parliamentary elections, there is also no sign of competition amongst the legislative personnel of the judicial organs. In Islamic societies, suggestions with regard to the responsibility of the legislative organs is merged with bureaucracy. The secret and semi-secret judicial system in operation within Islamic communities is what has raised the anger of the educated sector of society and that of international organizations. It is common knowledge to the public both in Islamic countries and throughout the world that the corridors of Islamic courts are preset in advance and no one willingly wishes to attend the court cases. With orders from above, so-called “knowledgeable” personalities and “scientists” are present in courts to review the cases. In these courts, there is not a single member of any social defense team present, and there are no representatives of foreign media allowed within the premises of these so-called “public prosecution” cases. Even the press from Islamic countries are refused entrance to court meetings. Inevitable questions arise as to whether the press in Islamic nations report the truth. If they do, why are representatives of the press banned from attending cases where progressives and writers are prosecuted? Is this not a sign of distrust towards neighboring Islamic states and their brother nations? Within recent years, the prosecution of progressives and writers in Iranian Islamic society have all had similar patterns. In Iran recently, the prosecution of Jews in one city have gone through similar treatment. They have all been accused of similar “crimes,” that is, their intrusion into nationalistic matters and their anti-social behavior. Such hidden forms of persecution have brought about opposition throughout the world, including in the Islamic states themselves. As an example, before the prosecution of progressives and certain distinguished members of society in Iran, other progressive forces in Islamic states demanded that court prosecutions were made open to the public, while the press neither announced the starting date of a prosecution nor provided any information during a prosecution. Only the Islamic press, providing distorted information to this effect, published articles. When there was an outcry in the non-Islamic world against this form of persecution, the Islamic authorities seemed very surprised. The public in Iranian Islamic society have had to resort to the BBC radio stations and the American voice to obtain information on such issues. No doubt this condition will further reduce the credibility of the leadership in Islamic society. In Iran, the persecution of the accused has brought complaints from individuals and the masses, amongst which was an open letter from students and scientists to the United Nations High Commission. This letter stated that the lack of information with regard to the prosecution of progressives and writers and the accusations against them “made us realize the future danger, and therefore in order to gain further information, we are forced to resort to outside sources of media. We are extremely anxious about current information, which states that prosecutions have taken place openly and legally. Our humanistic duties force us to raise our voices in opposition to such atrocities and demand assistance from humanitarian sources to prevent the judiciary system of the Islamic party of Iran to abuse human rights so openly. Therefore, we demand that the accusations against our progressive forces and writers are considered void, and we demand the open prosecution of the accused, hundreds of distinguished individuals’ behavior towards Islamic officials.” Some of them condemned the constitution of the country as invalid, and some considered the legislative approaches of Islamic laws to be in contradiction to those of normal human societies. The letter also stated that “the only crime brought against the accused is that of their disagreement with the Islamic leadership. The justice system in our country has turned into a destructive machine against those criticizing the system while critics are meant to be productive in the social life of any system. We feel threatened by the presence of this system. We want our judicial system to operate in accordance with standard human norms and to take human concerns seriously.” (1)
