July 14 2012 The Landlord again came to the edge of the rental property making verbal threats stating that the law was not going to do anything about it. I started contacting the news media in attempts to expose the Law enforcement for denying me the right to equal protection from his intrusive behavior and actions. I then took a piece of side walk chalk out onto the car port and wrote, “I’m being harassed by the Caldwell County Sheriff’s department I have been brutalized during arrest by Sgt. E. Davis And Joseph Mc Craw; I was placed into Officer Mc Craw’s patrol car and the heat was turned on for the purpose to choke me during transport on 7-07-12 The Landlord then drove across the yard of my rental residence on his ATV without invitation or lawful justification and proceeded to call the sheriff’s department on me for trespassing as I filmed him on my phone. The Landlord states that Captain Bennett is personally handling his case. I also contacted the Caldwell County sheriff’s department and stated that the Landlord was on the property without lawful justification and I wanted him escorted off the property. Telecommunications told me to deal with him and hung up. I contacted the magistrate’s office to advise them that I was a legal tenet of the rental property of 1080 Dudley Shoals Rd. I stated that law enforcement was refusing to enforce my rights as a renter. The Landlord then drove back across the yard to his residence after he states the “sheriff’s department coming. ‘I stated the better not. As he, left I washed off the sidewalk to show no damage occurred from the chalk. Caldwell County Sheriff Deputies Chad Price and ____ responded to the Landlords residence of 1060 Dudley Shoals Rd Granite Falls, then walks across the yard of my rental residence with the Landlord. Officer Price approached me with a Misdemeanor Criminal Summons 12CR052238 issued 07-10-12 to appear in court July 30th which states that I unlawfully and willfully did without authorization enter and remain in the building of the Landlord located at 1080 Dudley Shoals Rd ,Officer ___ states, “Get your paper and go. ‘I said I live here sir, Officer Price states; “No you don’t. Officer ___ states; “Get your paper and go; ‘I state ‘I live here sir. Officer___ handcuffed me as Officer Price tells Officer ___to wait, as he quickly folds the criminal summons and places it into my pocket.During the arrest, the Landlord notices that my son is filming them and says the boy is filming this. Officer Price states ‘I’ll get it and walks toward my son in an attempt to take my cell phone. Officer Price seized the keys to the house and a storage building containing my husband’s tools of trade despite Posted Notices ‘NOT TO TRESPASS with my attorneys contact information posted. Officer Price instructs my son to remove the locks from the storage building; also posted with No Trespassing signs and my attorneys contact information. Officer Price then instructs my son to leave the residence immediately or he would be arrest for trespassing as well. Officer Price states my son can take our pet and nothing else; my son left the rental residence on Foot carrying our pet, as Officer___ escorted me across the yard of my residence in handcuffs to the patrol cars parked at the Landlords residence. Officer___ then transports me to the Magistrate’s Office driving by my son walking with our cat to my brother’s residence. I received an additional First degree trespassing charge upon arrival to the Magistrates’ Office 12CR052308; Which states I was Arrested Without a Warrant and detention is justified because, I unlawfully and willfully did without authorization enter and remain in the Residence of the Landlord located at 1080 Dudley Shoals. I attempted to show Magistrate Walker my driver’s license listing the rental address which was issued to me in 2008; He states that he does not want to hear it and I was put in a small room while my bond papers were processed. My bond was set for $500.00 secured and I was taken to jail. •GS 14-159.12 First Degree Trespassing did not apply to me, as I was a Lawful Tenet of said Property. •The Fourteenth Amendment prohibits the deprivation of liberty or property without due process of law. •TITLE12.CRIMINAL PROCEDURE Chapter 2: Process - Warrants and Arrest § 206.Use of penal summons in lien of warrant of arrest. § 207.Execution of warrants and service of penal summons
