Dear Mr. District Attorney: Your investigators begin their retelling of the facts of the Gutierrez homicide: Granado and his ride along are on patrol at approximately 4:14 a.m. The Taser activity report shows Granado activating his Taser for the first time at 3:57 a.m. He activates his Taser weapon for the 15th and final time at 4:06 a.m. He would wait an additional 8 minutes before he contacts his dispatcher for the first time at 4:14a.m. to tell her has a drunk driver in custody. He does not mention a struggle or that he has TASERed Edmund multiple times. He does not request medical help. Granado tells investigators he suspected the vehicle had just been stolen but he does not notify his dispatcher he is pulling him over. Granado saw Edmund when he drove past him. Granado shined his spotlight on the driver. He saw a clean-cut kid with glasses, alone. The statements by Joe Beard that Granado called his dispatcher after the second time he TASERed Edmund could not be true. 1. Garibaldi would have responded to the scene while Granado was still TASERing Edmund. He did not. 2. The dispatchers from two separate agencies would have had to sit on a call from a cop requesting assistance and then requesting immediate assistance for 20 minutes. That would not happen. 3.Officers were dispatched at 4:17a.m. after Granados transmission: One tazed, at 4:16a.m. This is a full 10 minutes after he TASERed Edmund for the last time at 4:06a.m. I do not believe Granado had any contact with anyone prior to 4:14a.m. That changes everything. He tortured Edmund. He hid what he was doing even from other cops. He and Garibaldi stood over a kid with his hands cuffed behind him, on his back, barely moving, on the ground and crying out for help. They bludgeoned Edmund with steel batons, over and over. I heard the witness describe what she saw. Joe Beard said all Edmund had to do is submit. he[Edmund]steadfastly refused. That is a lie. Her statement was recorded; listen to it. Your investigators and your assistant got the facts wrong. They even convinced you the Medical Examiner and Coroners Office got the cause of death wrong. Beard decides Edmund died of natural causes: It is entirely possible that Gutierrez own physical exertion that evening would be enough to kill him all by itself. Beards theory is not remotely possible. You can call Dr. Garber. Ask him yourself. One phone call. Restraint causes death by asphyxiation. He could not breathe because he was strapped to a hard surface on his stomach. He could not position himself to take a breath. He couldnt lift his chest off the surface of the backboard to expand his ribcage because he was strapped down in the prone position. He suffocated and his heart stopped. Beard never even mentions the cause of death in his entire report. His research consists of visiting a health magazines website. He lifts a paragraph out of an article on hypertrophic cardiomyopathy. He fabricates a cause of death. Leaving no stone unturned. Your words; your promise. They got it wrong from the first sentence, sir. If they made this up, you need to know. You did not listen to the radio traffic. You can easily take a few minutes to check the recording. I can not get access to it. We are going to destroy this investigation if you do not look at it with your own eyes. This is it. We will find someone who cares about the truth in the State of California.
