Just listening again to the Plano City Attorneys dismissal of trans persons in her description of the new nondiscrimination ordinance is really raising my blood pressure. I have to call it a night. Im being told by people Ive trusted in the past that the ordinance allows for restrooms to be separated by gender. Im now reading the text carefully, but so far havent found anything like that in the text. Where that seems to come from is the City Attorneys description at the beginning of the session, where she was describing what the ordinance will do. Heres the full context. You can listen for yourself here: planotx.swagit/play/12082014-1248, and the part people are referring to is at the 5:40 mark of the Item 3, Part 1 video segment: And, the first most common misconception was the concern over the restroom usage. And I want to make it clear that nothing about this ordinance is going to change the way individuals are used to using restrooms in public facilities. The restrooms are, weve created a specific exemption for public restrooms, and it is still permissible to segregate restrooms based on gender. We realize that privacy interests need to be balanced with equality interests, and so we thought it was very important based on the way that most public restrooms are set up, that they are semi private, separated by gender, and multiple people are usually in the restrooms that its important that businesses still be, continue the practice of separating these on gender and it will be based on physical anatomy and not how people perceive their identity to be. So nothing about the way individuals use restrooms today will change if the ordinance is passed. Repeating that most important bit: Restroom use will be based on physical anatomy and not how people perceive their identity to be. This allows persons in control of public restrooms to challenge anyones presentation to allow entry into a restroom. This is not nondiscrimination. This is establishing a legal right to harass. Those only listening to the first part of this passage are seriously misrepresenting the City Attorneys words here.
