Your listing was found to violate the trademark rights of Gerber Childrenswear who is the exclusive owner of the trademark ONESIES®. UNLESS the item is a genuine Gerber product, you do not have authorization to use the term ONESIES, ONESIE, ONSIE, ONEZIE, 1Z, or anything confusingly similar when referring to one-piece garments in your listing title, product description or its keywords. As a trademark owner, Gerber Childrenswear has the responsibility to monitor how others use the ONESIES® trademark in the marketplace and to take appropriate action if someone uses ONESIES® in a manner that may dilute the distinctiveness of the ONESIES® brand or is likely to cause confusion among consumers. Using onesie to market and/or refer to one-piece garments creates a commercial impression that is extremely similar, both in sight and sound to Gerber Childrenswear’s ONESIES® mark, and will be perceived by consumers as a singular version of the ONESIES® mark. We review and report thousands of listings every week. Unfortunately, given the large volume of infringing products in the marketplace we cannot always find, review and report everything out there. Please note that we are continually addressing these types of unauthorized items in a similar fashion. The fact that others are selling products that infringe on Gerbers trademark rights does not give you the right to do so. As a seller, you have a responsibility to ensure that your actions do not violate the intellectual property rights of another. We would be happy for you to re-list your auctions after removing onesie or any confusingly similar term from the listing title, product description, metatags and keywords. Generic alternative terms include bodysuit snapsuit, creeper or one-piece. Thank you for your attention to this matter.
