Justice First, Constitutional Government to actually relying on the law to govern the country 公正第一，宪政才能依法治国 —— 给挪威诺贝尔委员会的一封信(二十二) 近段时间，较少浏览网站，闻为宪政，网络上的左右、伪民主炒作得热闹。 宪政，简单来理解就是以宪法来执政、依法治国。希望“宪政”的人士，是希望实现西方民主国家的宪政，希望实现真正的依法治国，实则是不承认现在的“宪法”。 被西方国家认可并加入联合国的社会主义国家（如朝鲜）的宪法难道你不承认它是“宪法”？虽然其起草没有得到社会大多数人的同意，或者社会的大多数人认为其 需要修改的时候，却被代表了，可不能因为其不够公正不够民主就否定其宪法的地位，还得承认它是国家的根本大法——宪法。 想想新中国成立的时候，有多少人为了我们的“宪法”欢呼。白纸黑字的规定其他法律以宪法为根本法，并为各行各业制定了各种各样的法律来治理社会，怎么现在的制度就不是“宪政”了？ 本质上，现在的中国也是一种宪政制度。只是，随着社会的进步科技的发展，信息的快速流通，于社会财富的分享出现的诸多不公正，老百姓不再承受、不愿再被代 表；而精英集团不愿放弃既得利益，掌握宪法的修改权和最终解释权。于是乎，就有了素质论、喝茶、截访、强拆...... 不能因为中国现在此起彼伏的矛盾，也不能因为追求民主自由法治，就违心的把现在的制度不当“宪政”看。西方国家的根本法是宪法，社会主义国家的根本法也是宪法，相对应的都是宪政。对要不要“宪政”展开的争论，笔者以为这很无聊且很滑稽！ 在现在的中国，现实非常的残酷，“宪法”和其他法律的制定和修改不能真正的民主，面对精英和代表们给你的、不知道是否公正民主的“宪法”，讨论“宪政”，诺贝尔奖的委员们，你们认为还有必要吗？ 探寻当前社会矛盾频出的根源，是社会“公正”的缺失。公正，是公众认为正、方为正，是人类群居的基础，是人类社会的维系；公正，是讲社会取向、讲人与人之 间的关系，也是讲每一个人对社会、对他人应持的态度(顾晓军语)。宪法有规定公民言论自由，你有吗？不就是因为“公正第一”的缺失，宪法成为了摆设。 所以，社会成员都讲“公正”，即“公正第一”实现之后，宪法才能是你、我、大家要的法，宪政才能真正的依法治国。 --- 无民主 2013-07-14 重庆 Justice First, Constitutional Government to actually relying on the law to govern the country - A letter to the Norwegian Nobel Committee ( 22 ) Recently , few visit the website , smell of constitutionalism around on the network , the pseudo democratic hype lively .
