Justice Waki Withdraws From MRC Case Leaders of the Mombasa Republican Council (MRC) have welcomed the decision by Court of Appeal Judge Justice Phillip Waki to disqualify himself from their appeal case. Justice Waki said he was disqualifying himself from the MRC appeal because one party was relying on documents from the commission on the post-election violence that he chaired in 2008. MRC Secretary General Randu Nzai says the Waki report on the 2007 post-poll chaos did not link MRC to violence at the Coast, with the judge opting out because his report was being used in the case. Nzai is now calling on Chief Justice Dr Willy Mutunga to order their case be heard in Mombasa or through video technology to be used with judges in Nairobi. The MRC appeal case which was transferred to Nairobi in early November, was termed as unconstitutional and an indication of lack of respect to devolution according to MRC. The outlawed group said taking the cases to Nairobi will deny its members an opportunity to attend to the court proceedings. The case in which MRC was opposing the March 4th 2013 general election at the Coast will be heard by a four-judge bench of William Ouko, Steve Kairu, Roselyne Nambuye and G.B Kariuki.
