KASHMIRI PANDIT CONFERENCE KPC None of us is above or stronger then all of us MEMORANDUM TO HONBLE PARLIAMENTARIAN DELEGATION. Respected sir, Kashmiri Pandit Conference (KPC) a prominent organization of Kashmiri Pandits submit their opinion, view point and other facts on behalf of the community to the Honble Delegation for their perusal and necessary action. Sir, Kashmiri Pandit community having its five thousand years history in Kashmir, highly nationalistic and law abiding citizens of the country, who have been hounded out of their homes and hearth for having no fault of theirs, presently in exile from last twenty Four years, failed to understand that why they are being marginalized, isolated , ignored and not being treated at par with other citizens of India. They neither expressed their anger on roads by burning buses, Govt, establishments, railway stations, nor took law and order in their hands by violating the curfew restrictions. They didnt pelt stones on security forces and government establishments which Kashmiri Muslims did. As compared to the separatists and stone palters of Kashmir valley the internally displaced Kashmiri Pandits have big reason and logic to come out on roads and streets as they lost their homes, brothers, sisters, relatives and leaders who were brutally murdered in various barbaric massacres in the valley. Some of them were raped and chopped off on bend-saws. There are hundreds of untold stories to highlight to open the eyes of those who have deliberately ignored this victim community and its youth in particular. Sir, highly qualified and peace loving Kashmiri Pandit Community, having 100%literacy and 0%crime, have contributed for the development of the country and the state for decades together, has finally been humiliated by forcing them to leaye their homes and hearth, burnt their houses, encroached and grabbed their land and property under land to tiller law as well as under distress sale. They were finally directly or indirectly banned to visit or stay at their birth place in Kashmir valley under life threat. They were negated from their basic rights and services to earn two time meals. Their voting right was made so complicated by adopting defective voting system which virtually deprived them from their right of franchise. Their names were tampered or deleted from the voting lists in the valley as they were not a part of Kashmir. Their religious property including temples and shrines are in shambles. Around two hundred temples were damaged, destroyed or burnt from the last twenty two years. Most of the land and property including religious one got encroached and are in a deteriorating condition. There were so many CBI probes, commission of enquiries, Judicial and Magisterial enquiries for the various incidents that took place in the valley, wheather it was Shopian double murder incident, killings at Spore, Anantnag and other places, but unfortunately none of the commission of lowest or highest nature was ordered for the enquiry of the incidents faced by the Kashmiri Pandit community, either connected to their massacre, loot or arson, genocide or mass exodus. Sir, despite of all jubes, humiliations and provocation, Kashmiri Pandit community restricted and restrained themselves for the sake of peace, prosperity and integration of the nation. Showing such quality of control, forbearance, broader vision, understandability of carrying ahead the rich values of their ancestors, exhibited broadmindedness and exemplary courage to face all violent means of anti-national and anti Kashmiri Pandit forces, deserves applaud, appreciation and support of the nation and the government at the centre in particular. Sir, in this background the state and the central government should reconcile with the aspirations of displaced Kashmiri community and to take cognizance of their nationalistic suggestions, views and to utilize their services to proper direction in nation building, prosperity and its integrity by placing them at various national institutions and think tank of the country. Besides to restore the confidence and faith of Kashmiri Pandit community on Indian system of governance, leaving vote bank politics and policy of appeasement aside. Let the central government appoint a fact finding committee exclusively for internally displaced Kashmiri Pandits to meet their leaders and sufferers in the camp and non-camp localities in order to know their pain, problems and demands to mitigate and also treat them the principal party of Kashmir issue as being the aborigines of the valley and first victim of militancy. Their participation would definitely pave the way to find the viable solution of Kashmir issue created by a section of separatists and pseudo secularists of Kashmir valley. An independent commission of enquiry is needed to probe the human rights violation of victim Kashmiri Pandit community, detailed action taken report in respect of those Kashmiri Pandits got killed since 1998-99 by the militants in the state. Most importantly the Kashmiri Pandit youth who were recently appointed and posted in Kashmir valley under draconian law need to be posted in safer zones of Jammu region. Kashmiri Pandit youth to be given age relaxation of at least seven years and settlement amount of Rupees twenty five lakhs to those over-aged youth who do not get employment. Monetary relief of Kashmiri Pandits also needs to be enhanced to Rupees Ten Thousand per family at the earliest. Non-camp migrants to be provided with the accommodation at par with the camp migrants. More importantly much delayed Kashmiri Pandit Shrine bill to be passed in the state assembly at the earliest to protect the temples, shrines and other religious institutions of Kashmiri Pandit community. Besides distress sale of Kashmiri Pandit community after their displacement, to be declared null and void. PM Package to be de-linked from the condition of KP’s return to valley, its benefit to be given at present location of migration. Displaced KP youths to be appointed in Central Govt. Department / undertakings like railways, LIC income tax customs and taxation, IB, CBI and others. KP Traders / shopkeepers to be allotted shops at railways stations form Jammu to Srinagar besides shops to be constructed at Jagti Township and other migrant camps for them. The overall empowerment of the Kashmiri Pandit community is of paramount importance to restore their lost credibility, honor, dignity and faith on government at centre, so 3-4 constituencies in exile are granted for their representation till they are settled at the land of Kashyap with free flow of Indian constitution. Sir, everyday we hear our politicians and leaders running the polity of the nation about return of internally displaced Kashmiri Pandits to their previous locations in the valley with minor rehabilitation package announced by the Prime Minister of India in the recent past was against the aspirations and demands of Kashmiri Pandits in general which has hurt their sentiments by declaring faulty-return plan. The whole return plan is uninspiring, hastily prepared with out any advance planning and preparation. It has no input from the genuine migrants for whom it is meant. Although the Prime Ministers package is welcomed but needs to be de-linked from the condition of return to their previous locations in the valley. The return of Kashmiri Pandits to Kashmir valley is a million dollar debatable preposition, which needs to be taken very seriously after taking in view the real ground situation of Kashmir and political demands of Hurriyat, National Conference, Peoples Democratic Party and others which are separatists in nature, taking Kashmir away from India rather to strengthen its ties with rest of India as is being aspired by the nationalistic forces. Sir, there is urgent need to take care of the facts that Kashmir belongs to all Kashmirs importantly of Kashmiri Pandits, who are the principal party of the issue, hence their plight needs immediate redressal and their more important genuine demand of consolidated rehabilitation is to be made at the land of Kashyap (in Kashmir Valley) to allow them to live together as a proud community under the complete writ and control of Indian constitution to contribute for the peace, progress, prosperity and integrity of the nation. Sir, we could understand that the present turmoil in Kashmir valley is a proxy war by Pakistan and periodic convulsion that the separatist leaders have to undergo to keep themselves visible and present on the muster rolls for getting the doles from across the border as well as to en-cash the weak and appeasing policy of the central government, but we fail to understand the double standard of so called main political parties like National Conference, Peoples Democratic Party and others who are directly or indirectly responsible for paving the way to brew up the turmoil and encourage the anti-national elements in the valley at the time of crisis by raising the demand of political solution of Kashmir as autonomy and self rule, which is not acceptable to nationalistic forces of the country in general and J&K state in particular. They are also strongly advocating for revocation of AFSPA, return of trained militants from POK under proper rehabilitation scheme, favored release of political detainees. They accused security forces of committing excesses in Kashmir being the responsible partners of J&K government. Their topmost priority should have been to concentrate and put an end to lawlessness and educate the people about freedom and autonomy they already enjoy and also to highlight the role of army and security forces for protecting their life and property at their life risk and facing other natural and man made problems, to serve the interests of common people of the state. This is a big concern to our nationalistic community. Sir, at the other hand Indian leaders at the helm of affairs have also failed to apply comprehensive policy and result oriented diplomatic tactics, but have become habitual of dialogue over dialogue with Pakistan as well as with separatists of the valley without any concrete results. Hence present crisis in Kashmir valley is also the culmination of wrong handling of sensitive Kashmir issue. The state and the central government and their political parties failed to Indiannise the situation in Kashmir, mobilize the Kashmiri masses and make them fully understand that Kashmir has its own separate constitution, its own flag and holds a special status. Hence autonomy and self rule have no scope to discuss or to consider. They also failed to make separatists and stone-palters understand that they have no doubt right to protest, but no right to destruct and bleed the nation for their selfish ends. Sir, at this grave situation strong think-tank is needed along with co¬ordination and consultation with nationalist forces, intellectuals, political analysts to face the challenge and at the same time to identify the hidden enemies, who are more dangerous than the enemies in open. Besides an urgent need of the hour is iron hand action against the separatists, anti-national elements and stone palters whose main objective is to bleed, drain and disintegrate India. Purchasing of peace, appeasement, flexibility and general amnesty towards anti-national and law breakers is not a healthy sign of good governance. Sir, to conclude, Kashmiri Pandits have resolved that Kashmir is an integral part of India, there is no scope of any debate or dialogue over it and its accession is full and final. Any one challenging it should be treated as a traitor and liable for action under law of land. Consolidation of displaced KPs at “Kashyap Homeland (in Kashmir valley) to live as a community together under free flow of Indian constitution. 2. High level commission of enquiry to be constituted to probe for genocides and enmass exodus of Kashmiri Pandits. 3. PM package to be delinked from KP’s return to valley, it’s benefits to be given at present locations of migration. 4. K.P. Shrine bill to be passed in the State Assembly at the earliest in order to safeguard and maintenance of K.P. temples and shrines In the valley. 5. F.I.R and action against those who are responsible for killing hundreds of innocent K.Ps and property looted, ransacked and burnt, during the turmoil in the valley. 6. Grant of four constituencies in exile till Kashyap Homeland is granted to the K.P community. 7. Funds and aid granted & allotted by the centre exclusively for the migrants to be utilized only for the displaced people without diverting them to other quarters and a committee of displaced K.Ps to be constituted to look after the proper utilization of these funds. 8. Release of 50 % of pending amount against the ex-gratia granted to displaced K.Ps in lieu of their houses burnt and damaged during the turmoil. 9. Displaced KP youths to be appointed in Central Government departments / undertaking like railway, LIC, Income Tax, customs and taxation, IB, CBI and others. 10. An Agreement with horrible terms and conditions which are necessarily to be signed by the displaced K.Ps unemployed youths to get job in the valley to be withdrawn immediately. Age relaxation of seven years to displaced K.P. youths and one time financcial assistance of Rs 25 lakhs to those K.P youths who are over aged beyond age limit to start their own business to share their domestic responsibilities. 11. Distress sale of K.Ps land and property since 1990 till date to be nullified urgently. 12. KP traders / shopkeepers to be allotted shops at railway station from Jammu to Srinagar, besides shops are to be constructed at Jagti Township and at other migrant camps for them. 13. Encroachment of land and property of displaced K.Ps and unauthorized occupation of their houses, shops and other business establishments, especially at religious places to be removed at earliest possible. 14. Contractual teachers of displaced community working at Delhi and other places to be declared as regular staff and financial benefits to be given to them at par with their other colleagues. 15. Bifurcation of migrant ration cards at Delhi and other places at par with Jammu migrants to be made at an earliest. 16. Dharamshalla of K.P community occupied by the local goons of the Haridwar to be got restored and released from them by the Govt. for the management by the K.Ps themselves.
