KITWE MAN SUES CHINESE DOCTOR FOR REMOVING HIS PRIVATE PARTS A KITWE resident has sued two doctors and the Health Professions Council of Zambia (HPCZ) for alleged wrong surgery after they removed his private parts without conducting laboratory tests. In a statement of claim in the Kitwe High Court, Joseph Mutale has sued Zhenqin Wang, a doctor, Zhiqiang Cheng, a surgical doctor, Dr Li’s Surgery situated along Independence Avenue, town centre and HPCZ. Mr Mutale of 1751 Mwandi Crescent, Riverside noted that the doctors were on government-to-government contracts, operating the surgery, while HPCZ was a professional body under the Laws of Zambia and mandated to regulate health professionals’ practice and matters incidental in the country. He said on May 16, 2011, he consulted Dr Wang at Dr Li’s surgery after developing a swollen testicle on May 10, the same year. After visually examining the plaintiff, Dr Wang informed him that he had cancer and that the testicle needed to be removed surgically and an operation would be arranged upon upfront payment of surgical fees. Mr Mutale stated that on May 19, Dr Wang brought in Dr Cheng to perform the operation and was further informed that he suffered from carcinoma, a membrane cancer which would progressively spread to other parts of the body. He was given a prescribed drug to be taken on a daily basis for life but that after taking the said drug, it caused him lack of sleep, fever and headaches. Mr Mutale said he informed Dr Wang of his experiences but the doctor assured the plaintiff that the experiences he was having had nothing to do with his medication. He noted that in July and August of 2011, his health deteriorated and on August 10, the remaining testicle got swollen in a similar fashion as did the other but was terrified to go back to Dr Wang for fear that he would prefer to remove it and leave him without any testicles. “As a result of the defendant’s actions, the plaintiff has suffered loss and damage and now claims damages occasioned by the plaintiff to health for invasive wounding, permanent loss of testicle, loss of fulfilling life, psychological scars, groin pain and loss of sleep,” read the statement of claim in part. The plaintiff further claimed damages for undertaking an operation without any histological or laboratory tests in pursuit of the provisions of health services. He has also asked for costs suffered from health challenges triggered by such wrong surgery and wrong treatment meted on him to get back to health. Source: Times of Zambia
