NEW DELHI: The chief electoral officer of Delhi has forwarded a report to the Election Commission holding AAPs protests outside the BJP headquarters on March 5 as a violation of the model code of conduct. Hours after Arvind Kejriwal was detained briefly in Gujarat, AAP workers had staged a protest outside the BJP office, leading to a pitched battle with saffron party workers. The district election officer of New Delhi then served AAP a notice for alleged violation of the model code of conduct for holding the protest without the poll panels permission. The model code of conduct came into force on March 3, when the Election Commission announced the dates for the Lok Sabha polls. While refusing to comment on the nature of action against AAP, sources said that the case was certainly a violation of the model code and a report with recommendations for necessary action have been sent to the EC which is expected to examine the matter on Monday. The CEOs office refused to comment on the contents of the report. Meanwhile, CEO, Delhi Vijay Dev has taken strong note of the AAP protest. The election office has warned political parties of criminal prosecution if such incident is repeated in defiance of the model code of conduct. In the first instance, opportunity is given to parties to explain their position, but if such incidents keep on repeating in violation of model code of conduct, criminal prosecution of the party will be done. Dev further said de-recognition of a political party is also a possibility, but that option is used when there is no alternative left. When MCC is in place, no dharna, rally, protest can be done without prior permission. This was prima facie violated in that particular incident, Dev added. Political parties have been asked to ensure that such incident do not take place in future, he added. AAP workers had fought pitched battles on March 5 with BJP activists outside the saffron party headquarters here, hours after former Chief Minister Arvind Kejriwal was detained briefly in Gujarat. The AAP had been served a notice by the Delhi Election Commission for alleged violation of the Model Code of Conduct over the protest. Delhi Police in its report had accused AAP protesters of indulging in riotous acts and using criminal force to prevent it from discharging their duty regarding Wednesdays protest that had turned violent. AAP in its reply had said it was an instant reaction to its chief Kejriwals detention in Gujarat. AAP said the protest was not a planned event and maintained that it respects the Model Code of Conduct.
