KOTA KINABALU: The High Court enhanced the whipping on a local man to three strokes of the cane for committing an armed robbery. Noor Faidzal was previously convicted and sentenced to eight years’ imprisonment plus one stroke of the cane for armed gang robbery. Judge Ravinthran N. Paramaguru however maintained the jail term of eight years for Mohd Noor Faidzal Abdul Salim as it was not manifestly excessive. He varied the sentence after allowing the prosecution’s appeal against the sentence. On July 17, the Sessions Court sentenced Noor Faidzal after he pleaded guilty to the charge framed under Section 395/397 of the Penal Code. The indictment provides for a jail term of up to 20 years and whipping, on conviction. He admitted robbing a 22-year-old shop assistant of RM43.40, six boxes of cigarettes, a box of condom and a bottle of perfume altogether worth RM61.10. The offence was committed together with an accomplice still at large while armed with a machete at about 3.25am at 7-Eleven on June 4. Earlier, deputy public prosecutor Raja Zaizul Faridah Raja Zaharuddin applied for the sentence to be enhanced on the grounds that the accused was armed with a machete. She said, although the machete was not pointed at the victim but the weapon itself had caused trauma to the victim. Noor Faidzal who was unrepresented asked for his sentence to be maintained as he is a first offender and he has a family to look after. He also told the court that he is remorseful with his action.
