Karzai administration has decided to convene a Loya Jirga (grand assembly) to decide the fate of U.S. soldiers in Afghanistan after reaching an agreement on principal issues. According to the Afghanistan constitution, the government negotiates the terms of an international treaty, signs it and and the national assembly will ratify it. Once ratified, it will take effect in Afghanistan without an executing legislation, according to the article 7 of the constitution. Article 111 of the Afghan constitution clearly states that Loya Jirga should only be convened in three situations; 1) when making decisions related to independence, sovereignty, and territorial integrity, and supreme national interests, 2) amending the constitution, 3) impeachment of the president. The assertion made by the Karzai administration that it cannot decide if they should allow immunity to the residue of U.S. troops post-2014 is completely baseless. The decision to give immunity (only in Afghanistan - because it is just a matter of jurisdiction) does not meet any conditions mentioned above to convene a Loya Jirga. Then what is the real agenda for convening a Loya Jirga? Perhaps, amending the constitution?
