Kashmir can not secede from India Sri Debi Prasad Bhattacharya has raised an argument that when Kashmir was annexed to India, the people there were given the opportunity to secede from India and form an independent state.Sri Bhattacharya is a government employee and he is a regular strange logic giver which is untrue. I request him to cite a single document where there is the existence of such a provision. During the time of partition, all the princely states were asked to join with either India or Pakistan. Maharaja of Kashmir Hari Singh signed the treaty of annexation with India when the Pakistani irregular armed forces attacked Kashmir. That treaty contained the provision of Article 370 where the people of the princely state of Kashmir were given certain special rights. No where the government of India had committed to the U.N. that Kashmir could secede from India at any time of their desire. This is a fabricated lie. Can Sri Bhattacharya quite from article 370 of the Constitution about such referendum? I challenge him. Article 370 says, except the Ministries of Defence, External Affairs, Finance and Communication, the Legislative Assembly of J&K will legislate on all other matters. Any law passed in the Parliament of India could only be implemented in J&K if they are approved by the State assembly. The Article 370 says, the J&K state will have a separate flag. The tenure of its Assembly would be 6 years, not 5 years like any other state Assembly. I t says, an outsider will not be able to acquire property there. A citizen of J&K would lose his/her citizenship if he/she marries an outsider. The CAG, CVC, etc. have no authority in J&K.
