Kathleen Dickson; Tina Minkowitz Yesterday at 1:05am Historic moment: UN Committee on the Rights of Persons with Disabilities adopts General Comment No. 1 on Article 12, dealing with legal capacity. Includes the prohibition of nonconsensual psychiatric interventions, and a statement that we retain our legal capacity to make decisions at all times including in situations of crisis. This is a huge boost to countries throughout the world where our colleagues are starting to work on dismantling guardianship, institutionalization, forced treatment and other abuses. It directly challenges all countries that have ratified CRPD and are retaining substitute decision-making and forced psychiatric interventions. The U.S. is a signatory but has not yet ratified the CRPD, and the Senate has proposed a large number of reservations and declarations that appear to be aimed at exempting itself from core obligations - it appears that would conflict with this General Comment.
