The prosecution do not have a cadaver, they dont have any DNA evidence either - they dont even know if the man is really dead. The prosecution evidence consists of the following: A witness - who claims that he didnt actually see the alleged crime because he was hiding in another room. He then ran from the premises in fear of his life, being chased by the accused. The accuseds dog attacks and bites the accused on the leg, so the witness stops running and accompanies the accused to hospital in a taxi. The prosecution have a cell phone which they allege to belong to the accused. Under cross examination the expert witness from the telecoms company, admits that the name and date if birth of the registered owner are not the same as that of the accused. The Police witness admits that the cell phone itself which has been in police custody since the date of the arrest, has been used to make several calls since, despite being in police secure custody. alleged calls from the same phone made approximately in the days after the alleged murder were triangulated using cell phone tower data. The prosecution expert witness triangulated the calls to a different house on a different street to that of the accused- despite the accuseds house being pointed out to the expert witness by the police in a drive past. Text messages which are alleged to come from that phone do not implicate the accused with any crime, they do not even refer to the victim or any crime. One message used completely out of context by the prosecution, was found on cross examination to refer to the accuseds child and mother. And lastly: video taken from the same phone shows a man with tattoos on the forearm holding a pickaxe, the tattoos do not match that of the accused who also has forearm tattoos, however the prosecution would like to allege holding a pickaxe in a video purports to illegality.. On the basis of the above evidence, I ask if the accused should even still be on trial? In any other developed legal system in the world, this case would have been thrown out ages ago..
