Agreed, only 1/3 each of the House of Reps or 120 out of 360 members and of the Senate 36 cum 37 Senators out 109 is required to serve the President with the notice of impeachment, the real headache is section 143 of the Constitution, if it has not already been amended. Will the cronies of the accused president allow the Senate President David Mark to quickly request the Chief Justice of the Federation to appoint a neutral and credible panel of 7 persons to investigate the over 52 alleged impeachable offences whose verdict cannot be challenged in court? If not amended, the Senate President may wait for the last day of the 7-day period to serve president Jonathan and NASS members, another 14 days for a non debatable resolution by NASS, another 7 days after the resolution of NASS for the Senate President to request the Chief Justice of the Federation to appoint a Panel of 7 persons to investigate and submit the report of its findings in 3 months, and another 14 days to pass a resolution to remove the president with a 2/3 majority. I have considered the last day in my calculations due to the Senates antecedence of support for the President. Hypothetically, NASS has a total of 4 months and 2 weeks even if it submits the notice of removal on 3rd Dec 2014 whereas we are just 2 months and 2 weeks to the 14th Feb 2015 presidential election. Can someone help us confirm the amendment of Section 143, otherwise NASS must amend it first. If they so want to amend it. Can they do it even if Lobbying and Ghana-must-go dont work? Where will they sit if they are denied access to the Parliament, tear gassed or house arrested by the Law interpreting Police and DSS. Shall they apply the doctrine of necessity to pass an exparte motion to sit anywhere in Nigeria? Alternatively, president Jonathan may be forced his own party PDP to either resign to save the country from anarchy, or mass protests similar to that of Burkina Faso in view of INECs inability to update even the voters register since 2011 coupled with the dust raising distribution of Permanent Voters Cards ( PVC). Can INEC perform magic in less than 3 months what it could not do in more than 3 and half years without FG fixing security by force or dialogue with the insurgents, restore confidence for the return home of refugees within Nigeria or in neighbouring countries of Niger, Chad and Cameroun. Will election be held in the North without the people participating? It is yet Uhuru. May the Almighty intervene as usual to save us from chaos, insecurity and a celebrated impunity. Ameen.
