Kudos to Atty. J.V. Bautista for explaining very well the jurisdictional issue in the Blue Ribbon Committee, or more appropriately sub-committee inquiry, on the Makati Building overprice. He is correct in saying that it is the Committee and not the sub-committee, and certainly, not just three of its members, that can resolve the jurisdictional question raised by the Binays. One may criticize the Binays for resorting to technicalities on what many will consider a simple hearing to ferret out the truth. But this is precisely why laws and rules provide for procedural and technical recourse --- the reputation and honor of a person is much too important to be left to trials by publicity. Ferreting out the truth must, at the same time, respect a mans right to be presumed innocent before he is adjudged guilty in a court of law. Investigative bodies like the Blue Ribbon Committee, or sub-committee for that matter, is not the proper venue for declaring a mans guilt or innocence. Neither is it a venue for maligning a person. It is supposed to be an objective body designed to determine facts and make appropriate recommendations on the basis of the facts it establishes.
