LAW MAKING IN INDIA : SERIOUS MISTAKES (section 498A and Domestic Violation Act) The government of India has been enacting peculiar and peculiar laws which are in contradiction with the Natural Justice. Under section 498A of IPC the police arrest the entire family of husband without any cognizable (visible) evidence of crime. Under the Domestic Violation Act, 2005 any female member of the family can hold any male member on trial in the criminal court. Family is a civil organization. It is like an autonomous body or corporate in modern state. Family relations are not subject to intervention by any government agency, like police or military. Family relations are not subject to trial by the criminal court in any civilized country. Even Folk laws like Muslim Shariyat Law (without any disrespect), is less cruel than Modern Secular Law of India. Government has no right to allow police into familial matter unless and until occurrences of any visible or cognizible (causing any injury) crime, like murder, rape, etc. It appears that the law makers of the country are enacting laws without knowing the philosophy and sociology of law. Thus they are making serious mistakes while drafting and enacting such peculiar laws penetrating the civil relations inside the family.
