LEGAL EDVICE®: Q: If I don’t talk to the police, won’t they think I am guilty? A: Yes, probably but so what? It matters more what the police can prove than what they think. Keep in mind that the police need probable cause to arrest someone but in order to be convicted, they must prove it beyond a reasonable doubt. While it can be confusing to understand what that means, it basically means that the police need less to arrest you than to convict you. Oftentimes the police may already be planning on arresting you but are looking for an admission to solidify their case. Other times, they simply do not have enough to arrest you but want to talk to you to see if you slip up and give them that little piece of information that they need. Sometimes the police will tell you that they just want to get your side of the story. Be polite and kindly tell them no thank you and do not speak to them without an attorney. The police are not the enemy, but sometimes the wrong people get convicted. Don’t let that happen to you! In the end, who cares if the police think you are guilty? It matters more what a jury thinks and if you refuse to talk to the police, it may help you to never have to have a jury decide.
