LHR is in the Land Claims Court tomorrow to oppose an application brought by Eskom that attempts to force 14 former labour tenant families to sign an agreement that would effectively waive their existing land use rights in Roosenekal near the Limpopo/Mpumalanga border. LHR brought an exception to this application on the basis that it is vague, lacks the necessary averments and is bad in law. In terms of the Land Reform (Labour Tenants) Act, the rights of former labour tenant families are strongly protected. Even in cases where the parties are willing to enter into agreements that alter existing land use rights there are several procedural requirements and approvals that need to be followed. However, our clients HAVE NOT agreed to any alteration of their rights.
