Anti, obwavu buli too much and tuli bakoowu nyo nyo nyo!! ---------------------------- Suspended Makerere University professor has filed a case before the High Court in Kampala- Civil division seeking to be reinstated and a court order restraining the University or its agents from investigating him. Prof Elisam Magara (applicant) sued the University and the Vice Chancellor, Prof John Ddumba Ssentamu (1st and 2nd Respondents respectively) over his suspension. In the civil suit No. 187 of 2014 dated December 31st, Mr Magara, a professor and lecturer in the East African School of Library and Information science claims that he was on December 4, 2014 unfairly suspended on wrongful accusations that he awarded marks to students and submitted them to the Head of Department without marking the scripts. It was further alleged that Mr Magara, claimed for and was paid funds for unmarked scripts. However, through his lawyers of M/S Akampumuza and Co. Advocates, Mr Magara, a former contender for the VC seat claims that he is being witch hunted and his suspension without a fair hearing by the university tribunal or being given chance to respond to the above allegations breached the principle of natural justice. “That the 2nd respondent (Prof Ddumba) also adjudged me guilty of gross academic misconduct and actions prejudicial to the proper performance of duties and the University image, a decision I challenged through my lawyers without corrective action or response,” states the affidavit sworn by Mr Magara. Mr Magara further contends that Prof Ddumba arrogated himself the power to hijack the statutory duties and powers of the university staff Tribunal and the Appointments Board and irregularly constituted an investigation committee to try him. “That the said committee of inquiry sent me the above email ultimatum to appear before it after the alleged date and time had expired,” he states further. Consequently, Mr Magara wants court to issue an order of certiorari quashing the decision to suspend him at half pay and referring him to appointments board to investigate Prof Ddumba’s intention to suspend him. He also wants court to issue an order of punitive and exemplary damages for what he calls the “Respondents’ highhanded oppressive treatment”. When contacted by Daily Monitor, Prof Ddumba maintained that Prof Magara was suspended because he awarded students marks and submitted them without marking the scripts. “As a VC, I have the powers to suspend him (Prof Magara) given the fact that his actions amount to gross misconduct and tarnishes the image of the University,” he said. Prof Ddumba further said Mr Magara was written to and he replied but his explanation was not satisfactory to him(Ddumba) and the committee that carried out the investigations.
