LOCKPORT – Kenneth S. Lathrop Jr., 27, of Ruhlman Road, Lockport, drew the agreed-upon sentence of seven years in prison Wednesday for shaking his infant son, leaving him blind in his right eye and developmentally delayed. The sentence was part of a Dec. 6 plea bargain in which Lathrop admitted to reckless assault on a child; it is the maximum for that charge. Lathrop also was barred from seeing his son until 2026. Nathan Lathrop was three months old when he wouldn’t stop crying, according to Lathrop’s statement to State Police about the Jan. 8, 2013, incident. Deputy District Attorney Holly E. Sloma said Lathrop demonstrated to investigators how he shook the child. “I got the impression he was rocking him and trying to calm him down,” said defense attorney Dominic Saraceno, who took over the case after the plea and tried unsuccessfully to get State Supreme Court Justice Richard C. Kloch Sr. to cancel it. Saraceno said he would have sought a trial because of reports that the baby had been in an auto accident and was seen being shaken by his mother. He also said some other members of the family are blind in one eye, suggesting a genetic link.
