Last night our client Rose gave birth to her 8th baby. She is 34 years old. Because of the risk to her life her doctor recommended a Caesarian section, which costs considerably more than a natural delivery. The doctor and our staff had urged her to consider a ligation at the same time. Unfortunately, under Philippine Law, Rose could not make this life-saving decision on her own – her husband had to agree. Roses husband, Ramon, a carpenter without regular work, refused to allow one, despite the pleas of Rose and her doctors. This shocking situation is unfortunately quite common, and indeed, the right to have a ligation without spousal consent was one of the provisions in the RH Law struck down by the Supreme Court. Rose’s doctors were concerned for her life, and fortunately they noticed her mother was present, and asked her to sign the form in her husbands stead. Thus Rose was able to get the ligation she wanted, and her baby is healthy and she is recovering. Rose will have to pay at least P30,000 for the caesarian delivery.
