Lawsuit settlement. A major victory. Congratulations to everyone who helped to raise hell about this execution of an unarmed man in his own front yard. This win is a shining example of why we must file lawsuits and make incredible noise. Of course, no amount of money can ever make up for the loss of Ernest Duenez, Jr. or this grave injustice that has gripped the entire family/friends for almost three years. I know that Earl Allen Boek and Linda L R Roberts, Alex M. Salazar and Deanna Brownen marched, spoke out by posting at media sites, as well as many of us including Walt Stawicki. The Bee news coverage and that of the Manteca Bulletin has been less than exemplary and I hope that this important victory which has inspired so many people gets exposure in great places. The family, in a statement below, said the life of Ernest was priceless, but they could not put their faith in a jury after juries have repeatedly allowed killer law enforcement officers to literally get away with murder. Millions of people viewed the dash cam video (https://youtube/watch?v=LhnY17F_eiQ), and 91 percent of those surveyed by the Los Angeles Times called for the prosecution of officer John Moody for killing an unarmed Ernest, who was shot 13 plus times in less than 5 seconds. Ernest is survived by his wife Whitney Duenez, son Dominic Duenez, parents Ernest Sr. & Rosemary Duenez, siblings Reyna, Sabrina, Gabriel and David Duenez. The family released this statement by Reyna: On behalf of the family of Ernest Duenez Jr., we want say thank you to our family, friends & supporters who have been by our side the last 33 months. This has been a very emotional, stressful and life changing time for our family. From the moment we received the news of our Jr’s murder the City of Manteca and the Manteca Police Dept. have done everything in their power to make our nightmare almost impossible to bear. From not allowing my mother the chance to hold my brother one last time while he was still warm, to immediately working to collude and cover up the murder of my brother and finally DA James Willett’s refusal to prosecute the murderer John Moody. We have to live every day with this injustice because the perpetrator wears a badge. Facing our civil trial in April, my brothers widow Whitney and my parents after much consideration have decided to settle our suit with the City of Manteca for 2.2 million dollars. My brothers life was absolutely priceless to us and we are outraged that we were backed into a corner where this was our best option. We would have had to put our faith in a jury and after the Kelly Thomas & Manual Diaz trials, we knew we couldn’t trust the system. This has never been about money. We have fought every single day of these last 33 months to shine a light on police terror. We accept this time in history. We will work as hard as we can to make sure that families who come after us will have better odds, are allowed vital information about an officers past conduct and are faced with a more informed jury pool. We will not stop fighting. We want John Moody in prison and will continue to work on a statewide and national level to change the laws that are allowing him to be a free man. The Police Officers Bill of Rights was intended to protect good officers from bad people. Instead, it protects lunatics with a badge, corrupt, evil people from prosecution and accountability. A police officers record on duty should be public not private and we ask for the support of the public as we work with other families and organizations to bring accountability to law enforcement. We also call upon California Attorney General Kamala Harris to do her job and protect the people from rogue police and killer cops.
