Legal Tip of the Day-Business Use Exclusion (Georgia Automobile Insurance Law-Frank E. Jenkins III and Wallace Miller III) Many automobile liability policies issued in Georgia exclude liability coverage for use of an insured automobile while the person using the automobile is employed or engaged in any business. Obviously, this exclusion is found in the personal family auto policies and not applicable to business or commercial policies. It is intended to limit exposure to the insurer for use of a private automobile in connection with a business endeavor. The business use exclusion may be worded differently by different insurers. But normally the policy exclusion focuses on the user of the vehicle rather than the vehicle being used. For example, one such exclusion issued in Georgia excludes liability coverage if the person using the vehicle is engaged in a business. The ownership of the car is immaterial. A non-owner, for example, who is using the automobile with permission of the owner, but while engaged in a business, will suffer loss of coverage under the terms of the business use exclusion.
