Legal Warfare in the East and South China Sea On Friday, China’s East Sea Fleet successfully expelled foreign military planes from Chinese air space, this according to the People’s Liberation Army Daily and other newspapers, such as Xinhua Daily. Friday was the first day of the Chinese New Year. An unidentified military plane was spotted in the morning, disrupting the peace and celebratory atmosphere. Airmen from East Sea Fleet were deployed immediately to expel the planes. The entire mission lasted less than three hours and released reports did not identify the national source of these expelled aircraft or even the exact location where the incident occurred. Last week, Chinese sailors parked three ships on a disputed reef 50 miles from the Malaysian coast and performed a ceremony in which they swore an oath “to safeguard [China’s] sovereignty and territorial interests.” Malaysia is building a naval base nearby to protect it against China’s claim. Earlier in January, the PRC province of Hainan announced that police vessels had begun enforcing a law to require “all foreigners or foreign ships” to get approval before they could fish in 2 million square kilometers of sea. This is an area five times the size of California and has long been worked by fisherman from the Philippines and Vietnam. On 5 December 2013, after the USS Cowpens refused a Chinese demand to depart the area, a Chinese amphibious dock ship crossed directly in front of the Cowpens and halted, forcing the Cowpens to maneuver to avoid collision. Chinese admiral Yin Zhuo said that the Chinese action was intentional and that American ships sent to observe PLAN maneuvers would be blocked. Defense analyst Tim Brown said that it reflected a growing willingness by the Chinese to engage in potentially reckless behavior.
