Looking back on the past year, one of the things that jumps out is a decision by a three judge panel of the 9th circuit court of appeals that said a school can ban the wearing of American flag apparel on cinco de mayo. the reasoning of the panel was that the school rightfully feared that Mexican heritage students could become upset and violent on seeing other students wearing a symbol of racism on a Mexican holiday. There are some problems with this decision. 1) cinco de mayo is not a Mexican holiday. like kwanzaa, it was made up by activists in the U.S. that wanted another holiday to celebrate for a specific group. Having spoken to numerous Hispanics that I work with, they all admit celebrating the day but acknowledge that in mexico it is considered another work day and nothing special. 2) The panels decision is in direct contravention of Supreme Court decisions that state that a hecklers veto cannot be a determining factor in whether an action can be banned. This means that just because a minority group, in this case Hispanic students, cannot be used as a justification to violate the constitutional rights of other students to wear pro-American apparel. 3) The panel stated that wearing pro-American apparel such as an American flag patch could be perceived as racist by Hispanic students. Since when is displaying pro-American sentiment, especially using items such as flag adorned shirts and flag patches a racist act? Using the logic of the panel, the wearing of a Mexican flag would be racist also, but the panel denied that fact. 4) I am a proud American. I fly a flag at my house 24-7-365 by using a weather proof flag and a spotlight for at night illumination. if you consider that racist, then call me a racist. As for trying to make me take my flag down, using a term familiar to 2nd amendment supporters MOLON LABE. I will not take down my flag and if you attempt to do so, you will find out the effects on the human body of a different number of firearm calibers. If you are so upset with America, you have the right to voice your opinion, and I have the right to tell you where you can stick your opinion. GOD BLESS AMERICA!!!
