Lots of misinformation about the Hobby Lobby case. Going to try to give non-partisan legal analysis. First, these cases involving competing religious interest cases are the most difficult and confusing cases. Both the majority and dissent made excellent points. Justice Kennedy was the Fifth and deciding vote as he often is. He wrote a concurring opinion. Reading through the tea leaves (educated guessing) he signed on with the majority, but only for a narrow decision which is limited only to privately held corporations and only applies to certain kinds of contraception. I do think the Dept. of Health and Human Services did not do a strong job of briefing and arguing the case, and conceded that the Plaintiffs had a sincere religious objection (which is an open question given that Hobby Lobby invests in contraception companies).
