M L Sʜᴀʀᴍᴀ, ᴅᴇғᴇɴᴅᴇʀ ᴏғ Nɪʀʙʜʏᴀ ʀᴀᴘɪsᴛs, ᴍᴀᴋᴇs ᴀ ᴊᴏᴋᴇ ᴏғ ᴛʜᴇ Nᴇᴛᴀᴊɪ ᴍʏsᴛᴇʀʏ ᴄᴀsᴇ On 1 September the Honble Supreme Court rightly dismissed with damages a frivolous petition filed by serial PIL petitioner and advocate ML Sharma seeking a direction to the Centre to find the whereabouts of Netaji Subhas Chandra Bose. The family members and admirers of Netaji express surprise that someone like Mr Sharma, who has nothing to do with the ongoing campaign calling for resolution of the mystery and declassification of all documents related to Netaji, should have approached the Court with a frivolous petition. We wonder if Shramas petition has anything to do with those who do not want to see this matter settled. The Honble Supreme Court in plethora of cases ruled that PIL should not be a Publicity Interest Litigation or Paisa Income Litigation and one should be very careful before filing a PIL as in most of the cases the subject requires thorough research or in-depth study to invite the attention of the Court to a public cause. It appears from press reports that in approaching the Honble Court, Mr Sharma was probably led by a desire to buttress his reputation of being a serial petitioner on all sorts of issues. Thus, when challenged by the Honble Judges, he was quick to backtrack and apologise. It may be recalled that that Mr Sharma pleaded innocence of the gang rapists in the Nirbhaya case. He was reported to have blamed the hapless victim and her friend for their misfortune. As such, we are horrified to see newsreports about the fate of his latest misconceived PIL being linked to the noble cause of seeking the truth about Netaji. The case about Netaji has its own merit and there is no way Mr Sharma was aware of them given his non-association to the cause or any of the persons articulating it in public interest. There is no doubt that that the nation wants to know all about Netaji and this is why people across the country are demanding declassification of all records relating to Netaji, being kept Top Secret and Secret on flimsy grounds. Propriety demands that if successive Prime Ministers, Home Ministers, Foreign Ministers and the senior functionaries could have access to the secret files many of which are over half a century old, citizens too should have the right to know all about the countrys national liberation struggle and the national heroes who embraced martyrdom or fought for the liberation of the motherland relentlessly.
