MEMORANDUM TO ECI ON MISUSE OF DISTRICT ADMINISTRATION AND STATE POLICE BY WEST BENGAL GOVERNMENT Memorandum before the Honble Election Commission of India ATTENTION: Shri V.S. Sampath, Chief Election Commissioner Subject: Misuse of District Administration and the State Police by the West Bengal Government. Vide this memorandum, the Bharatiya Janata Party seeks urgent intervention by the Honble Election Commission of India into a large scale issue of arrest warrants against leaders and activists of the Gorkha Janmukti Morcha (G.J.M.), with a view to intimidate the G.J.M. supporters and the general public of Darjeeling District (West Bengal) who are supporting the candidature of Shri S.S. Ahluwalia, BJP candidate in Darjeeling (West Bengal). It may be recalled that vide Memorandum of Agreement dated 18th July 2011 executed by (i) Government of West Bengal, (ii) Gorkha Janmukti Morcha (G.J.M.), (iii) Government of India; signed in the presence of Shri P. Chidambaram, Honble Union Home Minister and Ms. Mamata Banerjee, Honble Chief Minister, West Bengal it was agreed as under: 28. The G.J.M. agrees to ensure that peace will be maintained in the region. 29. A review will be done by the State Government of all the cases registered under various laws against persons involved in the GJM agitation. Steps will be taken in the light of the review, not to proceed with prosecution in all cases except those charged with murder. Release of persons in custody will follow the withdrawal of cases. 31. The implementation of the provision of the Memorandum of agreement shall be periodically reviewed by a committee representing the Government of India, Government of West Bengal and G.J.M. (Copy of the Memorandum enclosed for ready reference). That after the announcement of the alliance between the Bharatiya Janata Party (BJP) and The Gorkha Janmukti Morcha (GJM), and the announcement of the candidature of Shri S.S. Ahluwalia as the candidate from Darjeeling Parliamentary Constituency; the West Bengal Government has unleashed a reign of terror in Darjeeling Parliamentary Constituency. During the last few days the Darjeeling Police has issued more than 600 warrants against G.J.M. leaders and cadres pertaining to cases that were registered during the Gorkhaland agitation. It is learnt that many more such warrants will be issued in the next few days. The aforesaid acts are a gross violation of the terms of the tripartite Memorandum of Agreement dated 18th July 2011, and are an act of political vendetta by the West Bengal Government/All India Trinamool Congress Party, against the G.J.M. for entering into an electoral alliance with the Bharatiya Janata Party in Darjeeling Parliamentary Constituency. The Darjeeling Superintendent of Police has falsely claimed to the media that the drive to issue arrest warrants is under the order of the Election Commission. That instead of withdrawing the cases against the persons involved in the Gorkhaland Agitation, the All India Trinamool Congress Party led West Bengal Government has unleashed an illegal and politically motivated crackdown on the G.J.M. supporters for supporting the Bharatiya Janata Party candidate Shri S.S. Ahluwalia in Darjeeling Parliamentary Constituency. We, on behalf of the Bharatiya Janata Party, request you to have the matter looked into, appropriate enquiries made, and thereafter suitable action be taken against the All India Trinamool Congress Party/West Bengal Government and the District and Police Officials responsible for the illegal and politically motivated act of issuing arrest warrants against G.J.M. leaders and cadres in violation of the tripartite Memorandum of Agreement dated 18th July 2011. In particular, we demand urgent implementation of Para 29 of the Tripartite agreement of 18.07.2011, cancellation of the arrest warrants and the release of arrested personnel. We are enclosing press clippings related to the aforesaid act of political vendetta of the All India Trinamool Congress/West Bengal Government.
