MJ Trust drags tenants to court... HYDERABAD: The Mukarram Jah Trust for Education and Learning (MJTEL) has filed as many as 21 suits in the city civil court after negotiations to enhance rents broke down with its tenants, including Setwin, a department of youth services agency. The trust has roughly 15 acres of land in the Old City. An MJTEL source said that despite the lease agreement expiring in 2010, Setwin continues to squat on two land parcels running into 11 acres in Motigalli and Azam Jah Palace, Purani Haveli. While the agency has been paying Rs 17,500 per month towards rent for both properties, the trust has demanded a fresh lease agreement with rents on a par with prevailing market rates. MTEL has demanded enhancement of rent to Rs one lakh for each property, the source said. Setwin paying such meager rents for the huge land parcels with suitable infrastructure in the heart of the Old City is not justified. We were forced to drag the matter to court after talks failed. They paid a lump sum amount but we treated it as damages, said MJTEL secretary Kamaluddin Ali Khan. Setwin officials, on the other hand, maintained that they are willing to negotiate. We have approached trust officials with higher offers. But Rs one lakh is unrealistic, said Setwin deputy manager Syed Abdul Qayoom. In another similar case, MJTEL has dragged Toor Bait-ul-Maal (TBM), another tenant in possession of a 1,500 square yard property in Khilwat, after a 30-year lease agreement expired. According to M Vidyasagar, the trusts standing counsel, TBM was paying a meagre Rs 30 per month since 1975 till 2005. The tenant agreed to enhance the rent to Rs 20,000 but failed to honour the agreement. Apart from TBM, we have filed an eviction suit on Friday against Nizams Trust. This trust is occupying around 3,000 square yards in our property called Single Mahal in the Masarrat Mahal complex. We need the area to expand Mukarram Jah School, Vidyasagar said. The trust also approached the court against defaulters of their property located in Nampally, Dabeepura, Yakutpura, Jillukhana and Himmatpura. The properties were sublet after the original tenants died. The rents here were as low as Rs 200 per month. Another 30 suits have been filed against tenants in Jillukhana. It is becoming difficult to continue with charitable work with such low rents, said MJTEL standing counsel Ali Akbar Mirza. Further, the imbroglio between the MJTEL, Princess Esin Girls High School (PEGHS) and Princess Durrushehvar Hospital (PDH) is dragging on even as the trust contemplates recovery of possession. While MJTEL officials claim that both the school and hospital are their tenants, school authorities contend that the property was bought decades ago. We had sent eviction notices to the school and hospital and have informed them that the property belongs to the trust. It cannot be bought or sold, said Vidyasagar. PEGHS and PDH officials were unavailable for comment.
