MPs Adjourn Debate On Health Report Tuesday, July 1st 2014 Confusion still surrounds a plan to revert devolved health functions to the national government, even as the House adjourned debate on a committee report to allow for amendments. Speaker Justin Muturi adjourned debate on the report by the House Committee on Health, which among other issues recommends the transfer of health services back to the national government. Although Schedule IV of the Constitution is clear that health services are a devolved function, transfer of the services has been a contentious issues, with claims that it was hurriedly done. Among the issues in contention is how the services will revert back to the national government since most county governments had already begun implementing the health function. Leader of Majority Adan Duale raised the issue of constitutionality and told the House that it would be impractical to implement recommendations that contravened the Constitution. We are discussing a function that has been devolved under the Constitution. This means that our hands have been tied. A recommendation of this House cannot contradict the provisions of the Constitution as far as the health sector is concerned, said Duale. Agostinho Neto (Ndhiwa) promised to introduce amendments to the report, arguing that in its current form, the recommendations contradicted the supreme law of the land.
