MUST READ!!! I am elated that my Bill which was an amendment to the Public Procurement and Disposal Act was finally passed by the National Assembly yesterday. The bill will now go to the Senate as this bill particularly affects Counties. The intention of the bill was to anchor in law and compel all Procuring entities at both National and County levels to ensure that 30% of the VALUE of procurement goes to the YOUTH, WOMEN and People Living with Disabilities as promised by H.E. Uhuru Kenyatta. Note - the bill talks about VALUE of procurement and not number of contracts. This means that if an entity spends 10Billion, a MINIMUM of 3B must go to these groups as opposed to just saying 30% of contracts where out of 10 contracts 3 go the these groups. This was being abused and youd find situations where out of the 10, the youth would be alloted simple contracts like bush clearing etc. The National government had already provided for the same as regulations but having it in statute gives it a greater force of law and thus compliance. Among other things, the bill now for the first time compels the county governments to comply. The bill also makes it mandatory that money to be paid out to the Youth, Women or PWDs must be paid out to accounts where the mandatory signatory of the account is the youth or the woman or the pwd as the case may be.
