MY REGISTERED LETTER TO THE EUROPEAN COURT OF HUMAN RIGHTS 26th November 2014 The European Court of Human Rights Allee Droits de l’homme 67000 Strasbourg France To whom it concerns, I have been involved in peaceful protests with many of my fellow countrymen and women, as is my lawful and constitutional right, under both the Irish and European constitutions. In the process of these protests, I was arrested by members of An Garda Siochana on 21st October 2014 and 5th of November 2014. I received a number of court dates for November 2014. For specifics, please see enclosed documentation in relation to the arrests and court dates. I am writing this letter, to request that the ECHR may intervene in this case, because of comments made by a Mr. Noel Coonan (TD), which were publicly aired on Irelands National TV and Radio stations and in Print Media (See enclosed document of proof). These comments were made on 20th November 2014, in Dail Eireann (Government Buildings) and have prejudiced my case. The comments were worded in such a way, as to compare Anti-Water-Charge Protesters with the “ISIS Terrorist Group”. Noel Coonan (TD) also called the Anti-Water-Charge Protesters, “Parasites”, and went further to mention the protesters in Dublin, specifically, even though there have been Anti-Water-Charge protests in every county and every town in the Republic of Ireland in previous months. The comments were in direct relation to people who were protesting, lawfully and peacefully and included comments, which tied left wing political parties into what I view as slanderous comments. I feel it is important to mention that I am not connected with any political party, or group and have simply wished to exercise my right to protest against what I view to be a step too far from the elected representatives in our Government. On 21st November, I was brought before Justice Halpin, where I made a request to have my case heard by the Supreme Court, or The Court of Human Rights. I was dismissed outright, before I could complete my request. My case was then remanded to a later date, to be confirmed. I am requesting help on this matter. I see only two options, which I will list in order of preference. 1) My case, having been prejudiced in such a manner, be taken outside of the jurisdiction of The Republic of Ireland and dealt with in another European Jurisdiction. 2) A judicial review be undertaken, with a view to having Irish Law changed, to allow an accused person, to elect to go forward and be tried by a Judge AND Jury of his peers for non-indictable offences. On point one, I would prefer this option, as I feel a decision could be made outside of the Irish Jurisdiction, without prejudice. On point two, this would at least allow my fellow citizens of Ireland to have a say, which I feel would create a more balanced view of the charges that are being brought before me.
