Thats why none of the people who call them illegals are able to point to a law they break. Furthermore, not only is it NOT illegal, international law specifically says its LEGAL. Everyone has a fundamental human right to seek asylum (under Article 14 of the 1948 Universal Declaration of Human Rights -un.org/en/documents/udhr/index.shtml#a14). Ironically, its Australia thats breaking the law, not the asylum seekers. Australia is bound by international law to assess asylum claims from people who come to our shores (under the Refugee Convention -unhcr.org/3b66c2aa10.html), and to protect them if theyre found to be genuine refugees. In turning boats back, arbitrarily detaining asylum seekers in order to deter others, and refusing to process asylum claims, were breaching that Convention. Were also breaching other international laws: • International Convention for the Safety of Life at Sea (SOLAS) • International Covenant on Civil and Political Rights (CCPR) • United Nations Convention on the Rights of the Child (CRC) • Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment • International Covenant on Economic, Social and Cultural Rights • United Nations Convention on the Law of the Sea (UNCLOS) • International Convention on Maritime Search and Rescue (SAR) • International Maritime Organisation (IMO) • Australia’s Criminal Code (Commonwealth) So who is going to step up to the crease Pro Bono and kick some arse? Our constitution allows ordinary folks to seek the third arm of government the (Judiciary, High court) to Order (Mandate) the Executive arm of government, to honour our treaties and stay within the bounds of those treaties, convention, international laws and declarations. The High court will order that all responsible officers shall administer treaties, and uphold their duties according to all treaties in which the Commonwealth is a party; and international law and: - Respond to distress calls and reports of asylum seeker vessels in danger - Provide rescue, medical treatment, legal advocacy and assisting asylum seekers with refugee status processing in a fair and fast manner as per International conventions. - Ensure accurate and public reporting of all asylum seeker rescue operations by the Australian Government, Customs, Border Patrol and Royal Australian Navy. - Close all detention centres offshore; and The High Court writ will mandate all heads of Federal Public Service departments and Armed Services, their agents and others acting on their behalf, to refuse to obey unlawful commands relating to any matter arising under any treaty ; Section 75.(1.) in order to ensure the universal human right to seek asylum is upheld.
