Man Convicted With 5 Years Imprisonment For #Molesting Woman in #Kashmir A local court in south Kashmir district of Anantnag awarded to five years imprisonment to a man on charges of gate crashing into the house of a woman neighbour and molesting her ten years ago. Chief Judicial Magistrate (CJM) Anantnag, Abdul Nasir after hearing argument from both sides held the accused Nazir Ahmad Bhat, resident of Bona Dayalgam,Anantnag guilty and yesterday sentenced him to five years of imprisonment. The court has fined Bhat of Rs 5000 and one year extra imprisonment and fine of Rs 1000 for the offense under different sections. The sentences awarded would run concurrently, the court order said. Bhat had forcibly entered into a neighbouring house of a married woman in September 2003 and molested her before fleeing from the spot. Police investigations found the accused involved in the offences under different sections of RPC and subsequently he was chargesheeted in June, 2006. The prosecution argued that in view of the evidences produced, the commission of offence by the accused has been proved beyond any doubt and as such deserved exemplary punishment. The modesty of the woman was outraged by the accused by entering into her house on the pretext of taking water and later holding her, dragging her on the ground and inflicting injuries to her body,” Special Prosecuting Officer (SPO), Syed Mushtaq Ahmad argued before the court. He said that the doctors have corroborated the injury caused to the breast of the victim and hence accused deserved to be convicted. However, the counsel for the Bhat argued that the evidence produced by the prosecution was suspicious and hence cannot be taken as proof and pleaded for his acquittal. The court after hearing arguments from both the sides said that the evidences produced by the prosecution have been well collaborated and credible except minor discrepancies and hence the guilt of the accused has been proved beyond doubt. He said that the accused entered into the house with the intention to assault the victim and caught hold of her and inflicted injuries by dragging her on the ground. The CJM said the act was done with an intention to outrage the modesty of the woman and hence the accused is found guilty and accordingly convicted.
